We only want to sell signs and show content that we, or our customers, have the right to use. If you own a copyright, or represent someone who does, and you find your work on myneongift.com without permission, this page explains how to ask us to take it down under the Digital Millennium Copyright Act (DMCA).
Where to send it
Email contact@myneongift.com and put “DMCA Notice” in the subject so it reaches the right person quickly.
Information your notice needs
The law asks for specific details. A notice missing any of them may not be actionable, so please work through this checklist:
- Identify yourself. Give your full name, postal address, telephone number and email, and tell us whether you are the rights holder or someone acting for them.
- Identify the work. Describe the original copyrighted work, or, if several works are involved, provide a representative list.
- Point to the page. Paste the exact link to every page on our site where the disputed material can be seen.
- Good-faith statement. Say that you sincerely believe the use you are reporting has not been allowed by the copyright holder, their agent or the law.
- Accuracy statement. Declare, under penalty of perjury, that what you have written is correct and that you hold the rights or may lawfully act for whoever does.
- Signature. Sign the notice, either by hand on a scanned page or by typing your full name as an electronic signature.
Our response
Once a notice with everything above arrives, we take the reported material offline or block access to it. If a customer supplied that material, we tell them about the removal and give them a copy of the notice where appropriate. If something is missing, we will write back and ask for it.
If your material was taken down
Customers who think a removal happened in error, or that the wrong material was identified, can reply with a counter-notice sent to the same address. It must contain:
- your name, postal address and telephone number, plus your signature, handwritten or typed;
- a description of what was removed and the link where it was shown beforehand;
- a declaration under penalty of perjury that you sincerely believe the removal resulted from a mistake or misidentification;
- your agreement to the jurisdiction of the US federal district court covering your address (or, for addresses outside the US, any district where My Neon Gift can be found), and your agreement to accept legal papers from the person who filed the takedown.
We forward a valid counter-notice to the original sender. If they do not let us know within 10 to 14 business days that they have gone to court over the matter, the material can be put back.
Customers who infringe more than once
Someone who keeps sending us wording or artwork that belongs to other people will no longer be able to place orders with us.
Please be accurate
Filing a takedown or counter-notice that you know to be untrue can lead to liability for damages and legal costs. When in doubt about whether a use is infringing, it may help to speak with a lawyer before you write to us.
